The leadership burden and Israel’s growth Moses reminds them that he once said he could not “bear” the people’s needs by himself. He ties the problem to good news: Yahweh has multiplied them until they are like the stars in number, and Moses even speaks a blessing that they would increase far more. But growth brings pressure—many responsibilities, heavy burdens, and interpersonal conflict that one person cannot manage.
Choosing recognized leaders and organizing authority Moses tells the people to select men who are wise, understanding, and well-known within each tribe, and he will set them as heads. The people approve the plan. Moses then appoints tribal heads and assigns leadership levels over thousands, hundreds, fifties, and tens, along with officers, distributing authority throughout the tribes.
Instructions for judges: fair hearing, no fear, and escalation of hard cases Moses charges the judges to hear disputes between “brothers” and to judge rightly between a man and his fellow Israelite and also the sojourner living among them. They must not show partiality: they must listen to both small and great cases alike and not be intimidated by any person. Moses grounds this in the statement that judgment belongs to God, and he adds a practical process: cases too hard for local judges should be brought to Moses. He closes by saying he commanded them everything they should do at that time.
Literary Context
This section comes early in Deuteronomy’s opening review of Israel’s past journey and failures and what they learned from them. Moses is speaking to a new generation on the edge of entering the land, retelling key moments to frame how they should live as a community. The paragraph about appointing leaders links Israel’s growth to practical needs of governance: more people means more disputes and decisions. It also sets a theme that will continue: Israel must organize life together under Yahweh’s direction, with leaders who judge fairly and responsibly.
Historical Context
Moses describes an earlier moment in the wilderness period when Israel had expanded into a large camp with many daily conflicts to resolve. A single leader handling every complaint and decision was not workable, so authority was shared through a tiered structure of leaders over groups of different sizes. This kind of arrangement fits a mobile tribal society that must settle disputes, maintain order, and prepare for future settlement. The mention of “the sojourner” reflects that non-Israelites could live among the people and still needed protection in legal decisions.
Theological Significance
Deuteronomy 1:9–18 presents leadership as a shared responsibility, not a one-person task. Moses describes Israel’s rapid growth as Yahweh’s gift (numerous “like the stars”), but that growth creates practical pressure: “encumbrance,” “burden,” and “strife” that require structured governance (explicit in vv. 9–12).

2) What “the judgment is God’s” emphasizes. Some take it mainly as source of authority: judges act as God’s representatives, so their rulings carry delegated authority. Others take it mainly as accountability: judges must rule as if God is the real owner of justice, so they must not bend to status, wealth, or threats.
3) What the “sojourner” receives in practice. Some infer the sojourner is to receive the same courtroom standing as an Israelite in disputes (“between a man and his brother, and the sojourner”). Others infer a narrower point: the sojourner is protected from being ignored or exploited, even if other laws might still distinguish between Israelite and non-Israelite in certain areas.
Moses retells events in a compressed way and does not name the earlier scene he is drawing from, which leaves room for overlap with other wilderness narratives. Also, key phrases (“judgment is God’s”; “sojourner”) are short and weighty, but not fully unpacked here, so interpreters look to broader Pentateuch teaching to fill in details.
