Question 1

How do verses 1 and 4 set two different restitution amounts, and what situations trigger each?

Accepted Answer

Verse 1 covers theft of an ox or sheep when the thief has made the loss permanent by killing or selling the animal. In that case the repayment is much higher: five oxen for an ox, four sheep for a sheep. Verse 4 covers a different scenario: the stolen animal is found “alive” in the thief’s possession (“in his hand”), whether ox, donkey, or sheep. Here the loss is not permanent because the animal can be returned, and the required repayment is lower: double. The text itself ties the scale to whether the owner can recover the animal and its value.

Question 2

What does the passage treat as the decisive difference between the “no bloodguilt” and “bloodguilt” outcomes (vv. 2–3)?

Accepted Answer

The decisive shift is the condition described as “the sun has risen on him.” In verse 2, when the thief is found in the act of breaking in and is killed, there is “no guilt of bloodshed” for the striker. In verse 3, when the sun has risen, bloodguilt applies for killing him. The passage does not add further explanation, but it clearly makes daylight (or a daylight-like condition) the factor that changes liability. It suggests the same kind of event—killing a break-in thief—can be judged differently depending on circumstances.

Question 3

How does the text keep restitution central even while discussing a lethal break-in encounter?

Accepted Answer

After addressing the bloodguilt distinction (vv. 2–3), the text immediately returns to the thief’s obligation: “he shall make restitution.” That line appears in the verse that also mentions bloodguilt, showing that the repayment requirement stands regardless of the killing question. Then it adds a contingency: if the thief has nothing to repay, “he shall be sold for his theft,” presenting a mechanism to cover the loss through labor. The structure highlights restitution as the main remedy for theft, with the break-in killing issue treated as an exceptional edge case.

Question 4

What different kinds of property does the passage mention, and how does that help define the scope of the rules?

Accepted Answer

The passage focuses on livestock: oxen, sheep, and in verse 4 it adds donkeys. Verses 1 and 4 give restitution amounts for stolen animals, implying these were key forms of wealth and livelihood. The specific listing also clarifies that the “double” rule in verse 4 is not only about oxen and sheep but extends to other working animals (donkeys). While the passage doesn’t claim to cover every kind of theft, the repeated focus on animals suggests it addresses common, high-impact property in an agrarian setting.

Question 5

What does “found breaking in” contribute to the meaning of verses 2–3?

Accepted Answer

“Found breaking in” frames the scenario as an active intrusion, not simply discovering a thief later. It implies a confrontation connected to the forced entry itself. That wording supports why the text might treat the defender’s action differently than in other settings: the encounter happens during the break-in, when the threat may be immediate and hard to assess. The phrase also functions as a boundary marker: the no-bloodguilt statement is tied to that specific circumstance rather than to theft in general. The text does not explicitly extend the rule beyond this moment.

Question 6

What is the passage’s logic for why “killed or sold” leads to higher repayment than when the animal is recovered alive?

Accepted Answer

Verse 1 treats killing or selling the animal as making the theft irreversible for the owner: the animal cannot simply be returned. Because the loss is final, the repayment is multiple animals, and the amount differs between ox and sheep, reflecting their differing economic value. Verse 4, by contrast, assumes the animal is recovered alive in the thief’s possession, so the owner can get back the original animal. The thief still pays extra (double), but the smaller amount fits the lesser, more repairable harm described by the text.

Question 7

According to verse 3, what happens when the thief cannot repay, and what does that imply about the system’s aim?

Accepted Answer

Verse 3 states that if the thief “has nothing,” then “he shall be sold for his theft.” The passage presents this as a way to cover the required restitution when the thief lacks property or resources. The implication from the text’s stated purpose is that repayment to the victim remains the goal even when the thief is insolvent. Instead of leaving the loss unrepaired, the system converts the thief’s labor into a means of compensation. The verse does not spell out the duration or conditions, only the repayment-oriented outcome.
